New California Laws for 2022

Hundreds of bills signed by Governor Gavin Newsom in 2021 took effect beginning January 1, 2022. The new laws address such varied areas as affordable housing, expanding voter access, worker protections, peace officer certification, crimes targeting people due to immigration status, and much more. California Supreme Court Unanimously Rules Against Early Release for Violent Felons

On January 3, the California Supreme Court issued a unanimous ruling that violent felons may not be considered for early release, even if their primary offense was considered nonviolent under state law. In 2016, California voters had approved Proposition 57, which allows individuals to petition for release for nonviolent felonies. State inmates had sought to extend the Proposition's language to those serving sentences for violent felonies.

California Enacts Workaround of Limitation on Federal Deduction for State and Local Taxes

In July 2021, Governor Gavin Newsom signed Assembly Bill 150 (AB 150), which enacted a workaround for the federal $10,000 cap on personal income tax deductions for state and local taxes (SALT). Under the law, certain business entities (called pass-through entities) may elect to pay an entity-level state income tax and their owners can claim a credit on their personal income taxes. The SALT cap had been enacted by the federal Tax Cuts and Jobs Act in 2017.
